At the end of 2019, on December 23, 2019, the eSocial deployment calendar changed.  Ordinance No. 1,419  extended the deadline for the start of sending events scheduled to be inserted into the system as early as January 2020.

The main changes include Group 1 Health and Occupational Safety events (business entities with revenues in 2016 higher than BRL 78 MI), and Group 3 Payroll events (Employers opting for the Simples Nacional tax regime, employers Individuals – except domestic – rural producer and non-profit entities).

The main changes

Group 3: Sending journals:

In this new update, the sending of journals in Group 3 had the main news. Periodic events include events that do not have a predetermined date to occur and related to labor, tax and social security rights/duties.

For example admission of a professional, salary adjustments, dismissals or work accidents.

The mandatory requirement that was scheduled for January 2020 was extended to September, October and November 2020.

Sending SST (Occupational Health and Safety)

The provision of the following events related to Occupational Health and Safety – SST will have schedule changes:

  • S-2210: Communication of Work Accident
  • S-2220: Monitoring of Workers’ Health
  • S-2240: Environmental Conditions at Work – Risk Factors

New eSocial groups

Two groups were created with the dismemberment of Group 4. They’re Group 5 and Group 6. Therefore, we have the following provision:

  • Group 1: business entities with revenues in 2016 above BRL 78 MI;
  • Group 2: business entities with revenues in 2016 of up to BRL 78 MI;
  • Group 3: employers opting for the Simples Nacional tax regime;
  • Group 4: Federal agencies and entities;
  • Group 5: state agencies and entities and the Federal District;
  • Group 6: municipal agencies and entities;

eSocial Simplification

According to the Department of Labor of the Ministry of Economy, the calendar changes arise to simplify eSocial program. The employer who does not meet the deadlines set is subject to penalties provided for by law. It is noteworthy that non-compliance with the schedule is detrimental to workers, who may face difficulties when receiving social and labor benefits.
